1. Information We Collect
Our data comes from two sources:
(1) Your electricity and gas utility (NYSEG) for managing electricity and natural gas supply (Community Choice Aggregation),
(2) Publicly available data
(3) Volunteered additional data about power, heat, vehicle and waste for managing transition to ownership (Own Your Power)
For Community Choice Aggregation, we will collect personal information including but not limited to the following:
CCA Opt-out Data
Name
Email address
Postal address
Phone number
Utility and supplier account numbers
Energy usage-related data
This data is made available to CCAs by Public Service Commission rules in order to implement an aggregation according to an opt-out process.

Own Your Power, being a voluntary offering requiring an affirmative and more deliberate decision to participate, will obtain data by a voluntary method.
As part of our engagement of energy users in voluntary opt-in DER projects, we will collect certain personal information and website usage data when you interact with our website and services, whether by phone, internet or in person.

The CCA data that Local Power will manage a limited but essential data set to Administer and plan the CCA program.

Participation in Own Your Power will require a detailed account of energy use at the building level by homes and businesses. Local Power will obtain individual permission from each energy user to use his/her utility account data and other data to join Own Your Power DER projects:

DER Opt-in Data
Other data related to power, heat/hot water, vehicles and waste for purposes of Distributed Energy Resource evaluation, design, financing, operation and administration.

Data collection will include commuter data to evaluate and design electric vehicle and electric vehicle charger systems.
Datasets will be used to design onsite energy systems for individuals and groups. This service will use low cost methods of preparing preliminary specifications for purposes of soliciting bids from DER developers.
Personal information may be provided at the customer’s discretion when requesting assistance in evaluating Distributing Energy Resource (DER) options, subscribing to Local Power's newsletter, signing up for Local Power-run events, enrolling in Community Choice Aggregation and Distributed Energy Resource programs, and owning or using Distributed Energy Resource projects.

2. How We Use Collected Information
We use the information we collect for the following purposes:
Personalizing Your Experience: To customize content, services, and communications to your interests.
Communications: To send updates, alerts, newsletters, and respond to your inquiries.
Processing Transactions: To manage program enrollments, handle donations, membership renewals, and other service-related activities.
Data Analysis & Improvement: To improve our website, enhance user experience, and monitor trends.
Security: To protect against fraud and unauthorized access.
For participants in Local Power's Community Choice Aggregation program, we collect utility account details to manage enrollment, opt-in/opt-out processes, and provide customer service.
Similarly, for Distributed Energy Resources we may collect payment information (encrypted for security), utility usage data, Distributed Energy Resource usage data, and energy loan data, or other data such as credit check results.
3. Data Security
Local Power signed a Data Security Agreement with NYSEG, New York State Electricity & Gas, in 2025, in order for us to have accurate CCA data for the CCA program.
Local Power employs various safeguards to ensure the protection of your data:
Encryption: We use SSL encryption technology to secure data transmitted via our websites.
Firewalls & Secure Servers: We maintain industry-standard security measures to protect against unauthorized access.
Physical & Procedural Safeguards: We employ strict access controls and security measures to protect personal data.
While we take reasonable steps to secure your information, please be aware that no method of online data transmission is completely secure. Use of our website is at your own risk.
4. Sharing Your Information
We do not sell, rent, or share your personal information with third parties, except in the following circumstances:
Opt-in Program Service Providers: When you voluntarily enroll in an opt-in DER and or CCA program through Local Power, your enrollment data may be shared with the associated program service providers.
Administrative and Data Service Providers: We may share information with trusted partners or third parties who perform services on our behalf, such as analytics, billing, fraud protection, or customer support. These parties are obligated to maintain the confidentiality of your data.
Legal Compliance: We may disclose information to comply with legal obligations, protect our rights, or respond to lawful requests from authorities.
5. Cookies & Tracking Technologies
We use cookies and similar technologies to collect website usage data, such as pages visited and interactions. This information helps us improve the user experience and measure the effectiveness of our services. We also use Google Analytics to anonymously track site trends.

In accordance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13 years of age. If we discover that a child under 13 has provided personal data without consent, we will delete this information promptly.

We may retain your personal information for a reasonable period after your interaction with our services, especially for backup, auditing, or legal compliance purposes. This retention will be in accordance with applicable laws and regulations.
